Collaborative divorce law is a newer and very different approach to divorce. Mediation and arbitration are also efficient and effective methods of alternative dispute resolution (ADR). But collaborative law incentivizes resolution with a pledge not to end up in court — the lawyers representing the parties are required to withdraw if the matter goes to court. How It WorksWith a goal of arriving at a resolution that benefits all parties, including children, the parties work with attorneys and any specialists such as child specialists, financial specialists, and divorce coaches they believe will help. The law states: 'Collaborative law process' means the process in which the parties and any professionals engaged by the parties to assist them agree in writing to use their best efforts and to make a good faith attempt to resolve disputes related to the family law matters . . . on an agreed basis without resorting to adversary judicial intervention." Like other ADR methods, collaborative law is less expensive and less time-consuming than traditional litigation. It is less adversarial and less fraught with stress, anger and resentment. It is more respectful of all parties and allows YOU, the client, to be in control... not the court system. Finally, it provides a level playing field where neither party is disadvantaged by a lack of funds for legal fees ResultsThe end result should be a set of documents that will be legally binding, resolving all matters such as property division and child custody and support. Collaborative law is not right for everyone. Parties who see the need to cooperate for the future of their children, and those able to be reasonable are good candidates for collaborative law.
